Asset Acquisitions from Bankruptcy Estates

Ice Cream Manufacturing Facility.  The firm assisted its client with the successful purchase of an Ice-cream manufacturing facility in the Los Angeles area,  Cool-a-Coo Ice-Cream.  The firm sought and gained a ruling of the bankruptcy court  which resulted in the disqualification of a competing bidder who appeared to be willing to pay more than the firm’s client. 

Almond Processing Facility.   The firm was active in gaining bankruptcy court approval for its client’s purchase of this going business in California’s Central Valley.  Here, the seller was anxious to conclude the transaction, but its lender attempted, through the bankruptcy court approval process,  to force terms on the buyer that were not agreeable.  The firm prevailed in keeping the transaction to the terms agreed to by the buyer and seller,  None of the onerous terms sought by the lender were included in the final court order approving the sale.

Real Property Purchases.   The firm is also able to assist purchasers with the purchase of real property from bankruptcy estates. Properties that are sold through the bankruptcy process include appartment buildings, raw land,  office buildings, commercial properties, and single family homes.   

Business Reorganizations

Hacienda Mexican Food Products, Inc. The client was a Mexican food manufacturer and distributor. The company's chapter 11 bankruptcy case resulted in a confirmed and consummated plan reorganization. ---

Hallmark Carpet Mills, Inc. The client was a carpet manufacturer which had fallen behind on design and production. The firm acted as bankruptcy counsel, and concluded a sale of the company's assets which resulted in a substantial recovery to creditors, and which resulted in payment of secured claims which had been guaranteed by the owners of the firm, resulting the exoneration of the guarantees.

Union China Investment and Development, Inc. This chapter 11 case involved a multi-million dollar high-rise office building in Monterey Park, California. The firm was successful in negotiating the lender's claim down from over $6,000,000 to just over $4,000,000, which lead to a confirmed plan of reorganization, and the preservation of the owners' equity.

Greenhorn Ranch, Inc. The firm represented the bankruptcy trustee in this chapter 11 case which involved a dude-ranch in the high sierras, and an adjoining subdivision. The case resulted in a confirmed plan of reorganization, and a higher recovery to creditors than had ever been thought possible by participants in the case.

National Pax, Inc. David Reeder represented the operating chapter 11 trustee of this specialty food manufacturer with annual sales of over $10,000,000.

American Adventure, Inc. This company, which owned a chain of R.V. resorts throughout the United States, was operating under bankruptcy court protection. David Reeder represented the company in resolving serious real estate title problems, which lead the way to the sale of the firm's resorts, and nearly a 100% payout to creditors. This took place after most creditors had considered their claims to be unrecoverable.

Creditor Representation

Madison Associates The firm represented the holder of a $33,000,000 malpractice claim against a national accounting firm which had filed a chapter 11 bankruptcy case. David Reeder's aggressive efforts on behalf of the creditor resulted in a payment of the client's claim in a much higher amount than originally offered by the debtor and the creditor's committee.

Zsa Zsa Gabor The firm represented a judgment creditor in the chapter 11 case of this entertainment personality. The firm successfully opposed her proposed plan of reorganization, which lead to a settlement resulting in a 100% payment to creditors.

Individual Bankruptcy Cases

S. and B., Newport Beach, CA. The clients were entrepreneurs whose manufacturing company had failed. They were being pursued by numerous creditors, and had numerous outstanding guarantees totaling over $1,000,000. Their chapter 7 case resulted in a discharge of debt, including all of the guarantee liability.

Harry R., Los Angeles, CA. A failed computer consulting business had resulted in debts totaling over tens of thousands of dollars for this hard-working entrepreneur. A well-planned chapter 7 case eliminated the debt, and gave him the relief that he needed.

L and E, Topanga, CA. After the failure of their family business, this young couple needed a fresh start. David Reeder consulted with them through all steps of their chapter 7 case, which resulted in a discharge of al personal and business debts.

Jon R., Los Angeles, CA. The family had filed a bankruptcy due to crushing medical bills incurred because of their child's illness. David Reeder preserved their discharge in bankruptcy from the husband's former business partners who had made unjustified accusations of fraud. After a trial before the bankruptcy judge, the verdict was in the husband's favor. Due to a litigation strategy devised by David Reeder, the entire trial took less than one hour.
